Is unlicensed music really something I should worry about?

While playing unlicensed music may not seem like a big deal, it is a significant issue, and we consider it a responsibility to educate our partners so you can make informed business decisions, compensate artists who provide the music we all enjoy and avoid any unnecessary legal risk.

Per the Recording Industry Association of America, playing unlicensed music for commercial advantage or private financial gain and sound recording infringements (including digital copies) can be punishable by up to five years in prison and $250,000 in fines. Repeat offenders can be imprisoned for up to 10 years. Violators can also be held civilly liable for actual damages, lost profits or statutory damages up to $150,000 per song.

 

Can I use an iPod in my business?

Technically, you can, but terms require that you pay for separate licensing, negotiated with each appropriate PRO.  Typically, it is much more expensive and time-consuming to navigate those waters on your own.

 

Can I use online streaming services for my business music?

Most streaming services specifically state that their content is licensed for personal use only.  When considering these services for commercial use, be cautious and read the terms and conditions carefully.  In the few cases where commercial licensing is offered, additional fees, equipment purchases or conditions may apply.

 

Can I simply turn on the radio for use within my business?

It depends.  There are certain exceptions where businesses can play the radio.  The exception rules depend on the number of speakers and/or TVs, square footage, etc.  It’s advisable to hire a lawyer to help decide if a business is exempt.  Is it worth it?
